1863 Supreme Court Halleck J. L. Folsom MAP Leidesdorff Sutter Judge Davis RARE

Description: These are two unique and scarce pieces, their rather stained and tatty covers are not indicative of their value. Their provenance, although impossible for me to authenticate or confirm, indicates that these pieces were in the possession of Judge David Davis, Lincoln’s associate, later appointed by Lincoln to the US Supreme Court. It appears that these two pamphlets were stored in the David Davis attic and were slightly charred and damped in the attic fire at the David Davis Mansion in Bloomington, IL ca. 1900 that resulted in damage to many of the items that were stored there. Some items apparently belonged to Davis and others had at one time belonged to some of his contemporary associates. SEVERAL boxes of similarly damaged pamphlets and/or books appear to have been discarded due to damages and eventually located in a succession of local bookstores. It appears that many of the items that escaped damages were eventually to find their way to the State Library. PLEASE NOTE THAT I CAN'T PRESENT ANY EVIDENCE TO PROVE THIS, IT IS CIRCUMSTANCIAL BASED ON THE OTHER ITEMS THAT WERE STORED IN NUMEROUS BOXES WITH THESE TWO PIECES, THE CONDITION, AND APPARENT OWNERSHIP MARKINGS. TWO FACTS CAN BE STATED: THERE WAS AN ATTIC FIRE CAN BE CONFIRMED AND THAT ROBERT BRUBAKER PUBLISHED THE DAVID DAVIS FAMILY PAPERS IN 1963 WHERE HE DESCRIBES THE INVENTORY AT THE ILLINOIS STATE HISTORICAL LIBRARY THAT INCLUDES NOT ONLY PAPERS OF DAVID DAVIS BUT MANY OF HIS ASSOCIATES. THIS INVENTORY AS WELL AS FORMER OWNERS IS SIMILAR TO ONES FOUND IN THE BOXES THAT CONTAINED THESE PIECES. PLEASE REVIEW ALL OF THE SIGNATURES, MARKINGS ,AND CONDITION CAREFULLY, I WILL BE HAPPY TO SUPPLY FURTHER PHOTOS OR ANSWER ANY QUESTIONS YOU MAY HAVE. I CAN ONLY VERIFY THAT THIS IS HOW I FOUND THESE TWO ITEMS WHEN PURCHASED IN 2006, I AM NOT QUALIFIED TO AUTHENTICATE SIGNATURES AND/OR MARKINGS. Two items as detailed below: In the Supreme Court of the United States December Term 1863 The United States Appellants vs. Executors of J. L. Folsom, Deceased GPO 46 pages Wraps cover string ties, 2 hole punched. Some edge darkening and damp stain to spine side covers (as indicative of fire and damping), with some slight wrinkling and edges rough as if trimmed of some charring. SEE PHOTOSrough foredge, some slight stiffness to the pages as they are turned but contents clean, a couple short pencil notations and marks throughout. Upper half of the cover has been inscribed “Davis” (presumably in the hand of Justice Davis but again, I cannot confirm) in pencil with various legal notations below “Lestus 641, Land Law 652, 21 Howard 454 14.Cal 548” Erratum page inserted between 26 and 27. I am unable to locate a record for this pamphlet in OCLC. Scarce and important in the tangled California land controversies involving Folsom, Halleck, Leidesdorff, Sutter, Catlin, etc. WITH Supreme Court of the United States December Term 1863 The United States appellant, vs. Halleck Et Al., Executors of J. L. Folsom, Deceased, et al Brief and Argument of A. P. Catlin, of Counsel [for appellees ] McGill & Witherow, Printers Washington DC 36 pages . Wraps cover string ties, 2 hole punched/stabbed. Some edge darkening and light damp stain to covers but contents fairly clean. Edges rough as if trimmed of some charring. SEE PHOTOS The bracketed “for appellees” from the title is handwritten in ink. A few ink corrections to text, possibly same hand as cover. Tipped in at the rear is a printed map, perhaps better described as a sketch approx. 23.5cm x 27cm. Map has 2 pin holes and 2 old stains, the center of the stains are tiny losses, about the size of a pen tip, the full stain is less than .5cm in size and not interfering with map line, printed titles or hand inked titles. No identification on the map regarding source. Leidesdorff Grant with American River, Willow Creek, Ward’s Ravine, Alder Creek, Buffalo Creek, and Oak Tree Beginning are all designated and printed in black type on the map. Sutter’s Sand, Rancho del Paso, San Juan Grant 3 leagues long by 1 ½ leagues wide have all been handwritten with red ink in their appropriate locations. Red, blue and yellow ink have been applied to the printed black outline as indicated by the printed map key. Red Boundary = Old Hayes Yellow Boundary + Survey ordered by Thomson and Blue Boundary indicated Judge Hoffman’s first opinion in 1861. I do not know if the map is unique or may have been included with another pamphlet (s) but I can verify it was not included in the only holding in OCLC for this pamphlet. I will be happy to forward my correspondence with the Huntington regarding that matter. Thus a scarce and possibly unrecorded map. Will be carefully packed and shipped fully insured.
